Are you a New Jersey Driver With Notice of Suspension from DMV?

Once you retain the Wolf Law to represent you we will immediately send a certified letter to the Division of Motor Vehicles indicating that we do not accept the proposed suspension and requesting a hearing before the Division. If this letter is received by the DMV before your suspension is scheduled to begin and states a valid reason to oppose the suspension, the Division will stay the suspension and you will be permitted to drive until the hearing is held. 
 
At the hearing we will appear with you and do our best to negotiate a reduction in the proposed suspension. If you are satisfied with the result, you can accept the decision of the hearing officer. If you are not satisfied with the result, you can reject the decision and request a hearing before an Administrative Law Judge. Our firm has represented drivers in both the DMV Conferences and Administrative Law Hearings for the past 50 years.

Drivers generally receive a Notice of Proposed Suspension for one of the following reasons:

  • If you receive 12 or more points on your current driver record

  • Failure to appear in court or to pay fines

  • Failure to pay surcharges

  • Driving with a suspended license

  • Failure to provide proof of insurance

  • Physical or mental disqualification

  • Drug or alcohol use while driving

  • Reckless driving

  • Vehicle abandonment on a public highway

  • Fault in a fatal accident

New Jersey Drivers Who Want to Get Their License Restored

Many New Jersey Drivers have been driving with a suspended license for many years. Some have financial difficulties that prevented them from getting restored. Others have suffered from drug or alcohol problems and are now in recovery and wish to resolve their past issues. Some drivers just don’t know where to start. 

Wolf Law can help. We will handle the restoration of your license from beginning to end. We will write to the Division of Motor Vehicles and get a list of all outstanding fines, unpaid surcharges, and open tickets. We will write to each individual court and find out what must be done to satisfy each court. We will arrange for you to pay the outstanding fines and appear with you in court to resolve the open charges. After all of the courts are cleared up, we will arrange for you to pay your restoration fee and get your license back.

Out-of-State Drivers Suspended in New Jersey

The National Driver Register (NDR) is a computerized database of information about drivers who have had their licenses revoked or suspended, or who have been convicted of serious traffic violations such as driving while impaired by alcohol or drugs. State motor vehicle agencies provide NDR with the names of individuals who have lost their privilege or who have been convicted of a serious traffic violation. When a person applies for a driver’s license the state checks to see if the name is on the NDR file. If a person has been reported to the NDR as a problem driver, the license may be denied. 
 
Since the states began checking the NDR before issuing license renewals, many drivers have received an unpleasant surprise.  Their Motor Vehicle Agency has refused to renew their license because the NDR reports they have a suspension in another state.  If that state is New Jersey, Wolf Law can help. We will write to the New Jersey Division of Motor Vehicles and get a list of all outstanding fines, unpaid surcharges, and open tickets. We will write to each individual court and obtain a clearance. We will arrange for you to pay the outstanding fines and appear in court on your behalf to resolve the open charges. Unless it is a very serious offense, most New Jersey Courts will not require you to appear from out of state. After all of the courts are cleared up, we will arrange for you to pay your restoration fee to have your privileges restored which will then be reported by New Jersey to the NDR as cleared.
 
The NDR is part of the National Highway Traffic Safety Administration (NHTSA). It keeps the computerized records known as the Problem Driver Pointer System (PDPS). This contains information on individuals whose license or privilege to drive has been revoked, suspended, canceled or denied or who have been convicted of serious motor vehicle offenses. The records maintained at the NDR consist of identification information including name, date of birth, gender, driver license number, and reporting State. PDPS conducts an NDR search and will “point” the State of Inquiry (SOI) to the State of Record (SOR), where an individual’s driver status and history information is actually kept.
