2014 Traffic Results

2014: Motor Vehicle Commission – Client received a Notice of Proposed Suspension for 360 days, stemming from two separate traffic stops, as a Persistent Violator for accumulating 7 points on his licence in a period of one (1) year.

Result: Attorney appeared with Client at a Motor Vehicle Conference and obtained a reduction to a 120 day suspension because at the time of the second stop, Client had not received proper notice for the first suspension. Further, Client relied on driving to get himself to work as well assist family members who could not drive.


2014: Municipal Court – Client was pulled over by State Police after being clocked on Radar at 110 mph in a 65 mph zone. Client was charged with 39:4-98 speeding (5 points) and 39:4-96, Reckless Driving (5 points).

Result: Attorney negotiated a plea where the Client pled guilty to an amended charge of 39:4-97.2, Driving in an unsafe manner and the reckless driving ticket was dismissed. Client had a fine of $445, but did not have any suspension of driving privileges or points.


2014: Municipal Court – Client was stopped by police for driving while her license was suspended in violation of 39:3-40. This was a multiple offense and she was facing 10 days in jail, a fine of $1000.00 and a six months additional license suspension.

Result: Attorney convinced Prosecutor that client was suspended for administrative reasons and did not know of the suspension. The charge was amended to 39:3-40i, Administrative Suspension and client was fined, with no license suspension and no jail.


2014: Municipal Court- Client rear-ended a stopped car at a red light and was charged with 39:6b-2, Driving without insurance (a fine of $1,000.00 and a mandatory 1 year license suspension), and 39:4-97, Careless driving (a 2 point ticket)

Result: Client pled guilty to the 39:4-97, Careless driving, charge and an amended charge of 39:29, Insurance identification card exhibited on request, and was fined $428. There was no license suspension.


2014: Municipal Court – Client had his driving privileges suspended for failure to pay surcharges. Client was pulled over for a violation of 39:3-66, maintenance of lamps, and was charged with 39:3-40, Driving when License is suspended. This was a multiple offense and client was facing jail and a 6 month license suspension.

Result: Attorney assisted the Client in having his license restored before court. Client pled guilty to 39:3-66, maintenance of lamps and an amended charge of 39: 3-29, failure to produce a drivers license, and was fined $378. There was no license suspension and no jail.


2014: Motor Vehicle Commission- Client received a Notice of 60 day Proposed License Suspension because he committed a speeding violation during a a one year probationary period.

Result: Attorney was able to negotiate the 60 day licence suspension down to 20 days because the client’s work required driving, and it would be a hardship to have his license suspended for any length of time.


2014: Motor Vehicle Commission – Client received notice that her licence was going to be suspended for 180 days for operating during a suspension period. This means that she received a traffic ticket at a time when DMV had her as having a suspended license, but, the Police Officer did not realize it and did not write her a motor vehicle summons for Driving While Suspended.

Result: Attorney appeared with Client at DMV hearing and was able to negotiate the suspension down from 180 days to 15 days.


2014: Municipal Court – Client was pulled over for failure to wear a seatbelt under 39:3-76.2F. When the police officer ran the licence and he found it was suspended and charged the client with 39:3-40, Driving while suspended in violation of 39:3-40. Client was facing a six (6) month suspension of driving privileges.

Result: Attorney negotiated a plea in which Client pled guilty to an amended charge of 39:3-29a, failure to exhibit licence, and 39:3-76.2F, lack of seat belt, and was fined. No jail and no further license suspension.
